Reporting Infringement

If you believe content on NetPulse infringes a copyright you own or are authorised to act for, send us a written takedown notice through our contact page. To be valid under 17 U.S.C. § 512(c)(3), your notice must include:

• A physical or electronic signature of the copyright owner or a person authorised to act on their behalf.
• Identification of the copyrighted work claimed to be infringed, or a representative list if several works are covered by one notice.
• Identification of the material claimed to be infringing, with enough information for us to locate it, such as the full URL of the page.
• Your contact information: name, postal address, telephone number and, if available, email address.
• A statement that you have a good faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law.
• A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act on the owner’s behalf.

What Happens Next

When we receive a complete notice, we will review it and, where appropriate, remove or disable access to the material. We may forward a copy of the notice, including your contact details, to the person who provided the material so they can respond. Incomplete notices may not be acted on; we may ask you for the missing information.

Counter-Notice

If material you provided was removed and you believe this was a mistake or misidentification, you may send a counter-notice through our contact page. Under 17 U.S.C. § 512(g)(3), it must include:

• Your physical or electronic signature.
• Identification of the material that was removed and the location where it appeared before removal.
• A statement, under penalty of perjury, that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
• Your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the United States, any judicial district in which the service provider may be found), and that you will accept service of process from the person who filed the original notice or their agent.

After receiving a valid counter-notice, we will forward it to the original complainant. Unless they tell us within 10 to 14 business days that they have filed a court action, we may restore the material.

Repeat Infringers

Where appropriate and in our discretion, we will restrict or terminate access for users or contributors who are found to repeatedly infringe the copyrights of others.

Misrepresentation

Under 17 U.S.C. § 512(f), anyone who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages. If you are unsure whether your rights are being infringed, consider seeking legal advice before sending a notice.
